Terms of Service
Introduction
Welcome to our fitness application, MCI (the “App”). By using the App, you agree to be bound by these terms of service (the “Terms”). If you do not agree to these Terms, please do not use the App.
A. Medical Clearance
You must obtain medical clearance from a healthcare professional before using the App. The App is not intended to replace the advice of a doctor or other healthcare professional. If you experience any pain or discomfort while using the App, stop immediately and consult a healthcare professional.
B. Free Trial
We offer a free trial of the App. During the free trial, you will have access to all features and content of the App. If you do not cancel your subscription before the end of the free trial period, you will be automatically enrolled in a subscription and your payment method will be charged. The duration of the free trial is up to the discretion of the App and might differ.
C. Subscription Options
We offer the following subscription options:
3 Month subscription: provides access to the App for a period of three months, renewable on a quarterly basis
6 Month subscription: provides access to the App for a period of six months, renewable on a six-monthly basis.
12 Month subscription: provides access to the App for a period of 12 months, renewable on an annual basis
The subscriptions, especially the specific trials, periods and prizes, are subject to change and up to the discretion of the company. Therefore, it might occur that not all the subscriptions options are available at any time and certain free trial periods or prizes differ based on special offers (e.g. via offer codes etc.).
D. Payment
All subscriptions must be paid in advance. Payment will be charged to your account at the end of the free trial period unless you cancel your subscription before that time.
E. Right of Withdrawal
You have the right to withdraw from your subscription within 14 days of the date of purchase.
We will support you throughout the withdrawal process.
Please note that the withdrawal is not handled by us directly, but through the respective App Stores (App Store and/or Google Play Store). Therefore, we assume no responsibility for the duration of the process.
If you withdraw from your subscription within the 14-day period, you will receive a full refund.
F. Refunds
We do not offer refunds for any subscriptions except in the case you exercise your right of withdrawal within the 14-day period. If you believe you have received a defective product, please contact us immediately.
G. Termination
We reserve the right to terminate your access to the App at any time, for any reason, and without notice.
H. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis. MCI Solutions GmbH (the “Company”) makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App. The App does not owe any specific result or that the user reaches a specific goal.
I. Limitation of Liability
The Company will not be liable for any damages of any kind arising from the use of the App, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
J. Governing Law
These Terms and your use of the App will be governed by and construed in accordance with the laws of Germany, without giving effect to any principles of conflicts of law.
K. Changes to These Terms
We reserve the right to update these Terms at any time. If we make any changes to these Terms, we will post the revised Terms on the App and update the “Effective Date”.
L. Severability Clause
If any provision of this contract is found to be invalid or unenforceable, such provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
